Another consideration is that you are negotiating a document that will apply both today and years into the future. If you make a mistake by not negotiating your best possible contract today, it will be a mistake that can last a very long time, and escalate the risks many times over. A bad lease can ruin your business.
Worse yet, much of the danger hides in plain sight. Phrases like “Tenant shall be responsible for its proportionate share…” or “Landlord shall not be liable for…” appear standard—because they are. But standard doesn’t mean neutral. And what’s common in one asset class may be overreaching in another.
